Best Practices for Conducting Board-Managed Independent Internal Investigation

ECI Chairperson, Martin Biegelman and ECI board member, Dr. Bradley Bondi, partner at Cadwalader, Wickersham &Taft, along with Brett Sisto, associate member at the firm, co-authored a paper that was presented at the 23rd Annual Association of Certified Fraud Examiners Fraud Conference (ACFE). The article, Best Practices for Conducting Board-Managed Independent Internal Investigation, highlights the importance of corporate governance and the crucial role of the board of directors in responding to allegations of misconduct. This oversight role is even more important in the current regulatory and legal environment. This paper discusses the responsibilities of the board of directors and the audit committee, and the best practices for when and how to conduct board-managed investigations.
